These Terms & Conditions ("Terms") govern your access to and use of the Srvd platform, websites, mobile apps, and related services (collectively, the "Service") provided by Servd Inc. ("Srvd", "we", "us"). By creating an account, signing in, or using the Service you agree to be bound by these Terms.
1. Eligibility & Accounts
You must be at least 13 years old to use the Service. Volunteers under 18 ("Minors") may participate only when an authorized parent or guardian acts on their behalf through a linked household account. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account.
2. The Service
Srvd helps organizations — including parishes, non-profits, schools, healthcare providers, and event teams — recruit, schedule, and communicate with volunteers. Administrators may invite, assign, re-assign, and message volunteers; volunteers may set preferences, accept assignments, request substitutes, and claim open slots.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose;
- Impersonate another person or misrepresent your affiliation;
- Access non-public areas, systems, or data without authorization;
- Interfere with or disrupt the Service or other users' use of it;
- Scrape, copy, or reuse content from the Service except as permitted;
- Use the Service to send unsolicited messages outside the bounds of your organization's legitimate volunteer communications.
4. Organization Administrators
If you use Srvd on behalf of an organization, you represent that you are authorized to do so. The organization is responsible for invitations it sends, content it stores, the accuracy of contact information it records, and compliance with applicable law concerning the people it schedules and communicates with.
5. Subscription, Fees & Trials
Some features may require a paid subscription. Fees, billing cycles, and renewal terms are presented at sign-up. Unless required by law, subscription fees are non-refundable. You may cancel at any time; cancellation stops future renewals but does not refund the current period.
6. User-Provided Content
You retain ownership of the content you submit to the Service ("Your Content"), including volunteer profile details, preferences, messages, and uploaded files. You grant Srvd a worldwide, royalty-free license to host, copy, transmit, display, and process Your Content solely to operate and improve the Service.
7. Communications
Srvd may send transactional emails, app notifications, mobile push notifications, and (if you opt in) SMS messages on behalf of your organization — for example: assignment reminders, sub-request broadcasts, schedule publications, and account activity. You may adjust the channels you receive in Settings → Notifications.
8. Intellectual Property
The Service, including its software, design, branding, and content (other than Your Content), is owned by Srvd or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service per these Terms.
9. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, fail to pay fees, or to protect the Service and its users. Upon termination, Sections 4, 6, 8, 10, 11, 12, and 13 survive.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet your requirements. Srvd is a scheduling and communication tool; it does not constitute legal, employment, or pastoral advice.
11. Limitation of Liability
To the maximum extent permitted by law, Srvd's aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of the fees you paid to Srvd in the twelve (12) months preceding the claim or USD $100. Srvd shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
12. Indemnification
You agree to indemnify and hold Srvd harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your misuse of the Service, your violation of these Terms, or your infringement of any third-party right.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Harris County, Texas, and you consent to personal jurisdiction there.
14. Changes to These Terms
We may revise these Terms from time to time. Material changes will be announced in the app or by email. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
